During the past six months, real estate executives in New York City have been in a battle of perception. A picture of declining rental rates, climbing vacancies and tenants returning space in droves has been at the forefront of many recent news articles. However, the fact is that New York Citys real estate market is not as weak as many believe. In fact, the citys residential market has shown signs of stabilizing and many neighborhoods are on the upswing. Currently, we are seeing rental rates begin to stabilize to the levels posted during the summer of 2001. We must always keep in mind that New York City still has some of the best restaurants, retailers and destination spots in the world, making it the perfect live/work/play city. Its no wonder then that people still want to call New York City home. In addition to renewed tenant demand in New York City, the job market is also beginning to show signs of recovery. Financial institutions, with a major presence in the city, are once again looking to hire quality employees. As a result, the market is poised to see a new generation of residents by the fall of 2002 and beginning 2003.
The Creditors Rights Commercial Law Practice Group Ice Miller Recent issues of the Cautious Creditor(R) addressed various aspects of Revised Article 9 of the Uniform Commercial Code (UCC), which will take effect in Indiana on July 1, 2001. This issue of the Cautious Creditor addresses the effect of Revised Article 9 upon real estate transactions and foreclosure of real estate-related security interests (other than agricultural liens and security interests in farm products, which will be addressed in a future issue of the Cautious Creditor). In general UCC Article 9 applies only to security interests in personal property and fixtures, not liens on real property. Revised Article 9 continues to respect this distinction, with a few notable exceptions. The most significant real estate-related changes include extension of Article 9s coverage to encompass not only security interests in promissory notes and payment obligations secured by real property, but also outright transfers of promissory notes and other payment obligations that are secured by real estate mortgages.
Editors Synopsis: The author examines how changes to the Uniform Commercial Code Article 9 relating to promissory notes secured by real estate mortgages may affect priority disputes between secured parties and the Internal Revenue Service. This analysis proceeds upon the following basic assumptions: First, the holder of a note and mortgage may transfer that holders rights in the instrument by a document of assignment without a physical delivery of either the note or mortgage. This concept is implicit in the Article 9 provision for automatic perfection of an absolute assignment of a promissory note.6 Otherwise, because possession is also a method of perfection,7 the provision would be superfluous. Second, attachment (i.e., creation) of a security interest8 in Article 9 collateral, including a promissory note, requires either (1) a security agreement authenticated by the debtor, or (2) possession of the collateral by the secured party pursuant to an agreement.9

A Vermont entrepreneur wanted to make products that would touch everyone. The result is a line that includes organic cotton bath towels and robes. “When I was young, I didnt tell anybody that I sewed because men are supposed to be athletes,” he recalls. “I would get a lot of looks when I would go to fabric stores because I was always the only 15-year-old guy in there. The other customers thought that it was really strange that I knew the sewing lingo and how to buy fabrics and notions.” After graduating from high school, Rayngay enlisted in the Navy and served as a Second Class Petty Officer from 1985 to 1988. He came to Vermont in 1988 to attend Bennington College as an ROTC student. In his spare time, he sewed pillows for his dorm room. “I was a tutor in physics and set up my sewing machine in the physics lab,” he says.

HOUSTON — Exhibit Takes New Perspective on Todays Global Oil and Gas Industry BG Group, one of the worlds leading players in the global energy market, and Harrison Lovegrove Co. Ltd., an international oil and gas advisory firm, today announced the exhibition of Gas, Oil, Man, a photo perspective on the global gas and oil industry by renowned British photographer Simon Townsley. The two-year photography project, sponsored by BG Group and Harrison Lovegrove, was completed at the end of 2004. It includes 28 color photographs, printed in large scale, of the gas and oil industry at work in California, Canada, Gabon, Louisiana, Liverpool Bay, Mongolia, the North Sea, Papua New Guinea, Scotland, Siberia, Sudan, Texas, Trinidad-Tobago, Tunisia and Vietnam. With the support of BG Group and other international oil and gas companies, Townsley was given unlimited access to oil and gas operations around the world.

Hypnosis is widely used and accepted as an adjunct to treatment for pain control, habit disorders, symptom reduction, and many medical problems. Although in the past the application and effectiveness of hypnosis have been questioned by the medical community, the clinical disciplines that use hypnotherapy have grown to include the medical specialties, psychiatry, psychology, and social work. In the last 20 years over 100 review articles have been published by a diverse membership in both the American Journal of Clinical Hypnosis and the Journal of Clinical and Experimental Hypnosis, which are the respective journals of the American Society of Clinical Hypnosis and the Society of Clinical and Experimental Hypnosis. The International Society of Hypnosis is composed of individual members from more than 20 national constituent societies. The use of hypnosis is widespread in various areas of clinical medicine, and family physicians are in an ideal position to address questions about the indications, misconceptions, and contraindications for the use of hypnosis. The physicians understanding of the history, theory, and clinical application can help guide the patient to this alternate therapeutic modality. Education in basic and advanced hypnosis can also enhance the family physicians armamentarium in diagnosing and treating many common ailments.

Kmarts home business is on the up and up. The introduction of MSE Home has been such a boon to business–generating more than $1.4 billion in sales from its launch in 1997 through the end of fiscal 2000–that it now stands as a prime example of how a lone brand can single-handedly energize a category. Home, however, will continue to be a core focus. One of Conaways first public appearances when he took over as ceo was the unveiling of MSE Kitchen. At the time, he said, “You are going to see more space [devoted to] home as the store evolves in the future.” The reasons for this are clear; home still offers plenty of opportunities for the company. The company will continue rolling out housewares segments in the aftermath of the kitchen debut. It will introduce an assortment of MSE storage and organization products in June, to be followed by home decor products later in the year, for a total of 700 new MSE skus in fiscal 2001.

Just as lead in products made in China has become big news, California regulators are preparing to crack down on the makers and distributors of jewelry sold in the state found to contain lead. The state Department of Toxic Substances Control is in charge of enforcing this law. In a posting on the agencys Web site, officials said they have already begun stepping up enforcement, both responding to consumer or worker complaints and conducting marketplace surveillance. However, the department wont be looking at dozens of companies that last year reached an agreement with then-Attorney General Bill Lockyer to limit lead content in the jewelry they make or sell. Major retailers including Saks Inc.; Liz Clairborne Inc.: Burlington Coat Factory Warehouse Corp., Target Corp. and Sears Corp. signed on to the agreement, as did manufacturers like Arden Jewelry Manufacturing Co.

American College for Advancement in Medicine Update ACAM and FAIM (the Foundation for the Advancement of Innovative Medicine) speedily joined forces to oppose the chelation ban. Under the leadership of Dr. Allan Magaziner — President-Elect of ACAM — New Jersey physicians quickly mobilized. The press was alerted, money raised, and an attorney and a lobbyist hired. Loyal chelation patients turned out en masse at the next Board of Medicine meeting, wearing buttons saying “Im elated — Ive been chelated!” According to Dr. Magaziners account: “We never expected what happened next. Surprisingly, [New Jersey Board of Medicine] President William V. Harrer, MD announced that he would open the floor for discussion and invite the attendees to speak on matters of their concern, i.e. chelation therapy. He stated since there were so many attendees with the same intention, he would ask that we choose 5 speakers to speak on behalf of the others attending. It was not hard to find 5 people ready to speak their mind concerning the benefits chelation has made in their lives. The panel listened. President Harrer said he would bring todays proceedings up at the next meeting and forward our concerns to the Executive Committee.”

The government agency, which oversees the advertising of nonprescription drags, has taken an aggressive stance on the claims made by health products in the last two years. He said the agency has filed more false advertising claims in the last two years than during the 1980s. The FTC issued 1,200 warnings after an international health claim Internet surf day Nov. 10, 1998 when numerous agencies surfed the Internet and assessed Web sites. Email the FTC at health-claims@ftc.gov to send complaints or comments about health claims on the Internet. Comment: Heres one effective way for the government to stop some of these rascals from getting the word out. Although its impossible for the FTC to crack down on everyone advertising products with misleading or false claims, such actions may encourage other companies and practitioners to think twice before they push their products. Its also heartening to see the efforts in policing the Internet, which has become a haven for quacks promoting everything.

Nursing home care in Utah is improving, the Centers for Medicare and Medicaid Services reported Wednesday. Many of those improvements were linked directly by care center administrators to a quality improvement project through HealthInsight, Medicares Quality Improvement Organization in Utah. The organization is part of the national Nursing Home Initiative, which focuses on raising standards of care in nursing homes across the country and giving consumers more comparison information.

Coverage of protest marches always seems to be a contentious issue. We get into trouble if we dont cover them, and often we get into trouble when we do. Estimates of numbers on any given march is a frequent matter of dispute, and when, last year, the figure we gave for an anti-war march was considered too low by readers who had attended it, they made sure we were told. The article, Ms Moore said, “seemed focused on picking fun at appearances, hair colour, `sensible clothing and belittling the attendees. I thought the kind of journalism that focuses on appearance and attractiveness was being avoided. It was usually used when writing about women and, quite rightly, decried as belittling and sexist. Am I to assume it is OK to resort to this when it is ageist?” I put these criticisms to the author of the piece, Robin Stummer. “There was no picking fun at appearances,” he said. “The comment about hair dye was made as a pointer to the fact that many retired people - now, in 2004 - were born in the 1940s, and are just as able and willing to change their appearance in later life as people 30, 40, or 50 years their junior. And that does mean hair and clothes.”
What should I consider when going for a change of colour? You must ensure your hair is in good condition before embarking on a change of colour and ensure you choose a shade that suits your complexion. For example, cool complexions should opt for ash shades and plummy/mahogany reds, and warm for golden blonde, soft coppers and rich chestnuts. There are several products on the market, some of which are excellent. Wash-in coloured mousses and semi-permanent colours can be fun to experiment with. However, leave the more technical procedures, such as highlighting, to a trained hairdresser.

William Henry Vanderbilt was the son of the financier and steamship and railroad promoter Cornelius “Commodore” Vanderbilt (1794-1877). He overcame both debilitating ill health during the first half of his life and his fathers skepticism about his promise as a businessman to establish himself in the railroad business by the time he was in his midforties. When his father died, William Vanderbilt inherited the bulk of an estate estimated to be worth about ninety million dollars. In less than a decade he had more than doubled the sum. By the time Vanderbilt engaged Herter, the firm had carried out decorating schemes for a good number of Americas newly rich, many of whom, like Vanderbilt, had made their fortunes developing the railroads that were crisscrossing the nation.(6) It is possible that Vanderbilt had visited and admired their houses, reinforcing his approval of Herter Brothers, which had previously decorated his house at 459 Fifth Avenue at Fortieth Street, where the Vanderbilts had lived since 1867.(7) In 1878 Herter Brothers proposed $16,355 worth of improvements to the drawing room of the Fortieth Street house, including a parquet floor “in rich, original design”; woodwork “of ebonized cherry inlaid gilt”; a ceiling “in distemper and gold”; “walls in distemper”; bronze chandeliers; curtains “of olive velours cisele trimmed with rich embroidered bands”; divans, armchairs, and “lady” chairs in olive velours; and light chairs and tabourets “in fancy covering.”(8)

However, this is only the tip of the iceberg in really understanding the value and leverage to be gained as a result of executive coaching. Minton, the Colorado College interim athletic director and former Air Force Academy mens basketball coach, has been hired by the National Association of Basketball Coaches as assistant executive director. He starts his new full-time job on Aug. 1 in Overland Park, Kan., after 33 years in coaching, all but three with the academy. Air Force did not renew his contract this spring after an 8-20 season, Mintons 16th as head coach.
Psychologists, MBAs, PhDs, even drama instructors–all are pitching in to help improve the work performance of top executives. The latest developmental approach, known as executive coaching, consists of a series of one-on-one interactions between a coach and an executive that attempt to improve the latters performance on the job. Several activities are involved: assessment, face-to-face meetings, telephone conversations, exchanging e-mail. Coaches serve as trainers, facilitators, motivators, moderators, devils advocates, sounding boards, and confidantes. Though not a substitute for psychological counseling or substance abuse treatment, coaching often assists practicing executives in addressing crucial managerial weaknesses and can empower them to higher levels of health and functioning. Executive coaching is an outgrowth of executive development programs. Like many other innovations, it seems to have sprung up simultaneously on the east and west coasts of the United States. OHefferman (1986) maintains that the first person to coin the term “executive coaching” may have been Dr. Dick Borough, a practitioner in Palo Alto, California, who used it to describe his leadership development activities in 1985. By 1988 it had become mainstream enough that it merited attention in Forbes magazine; in a rather derisive article by Dyan Machan entitled “Sigmund Freud Meets Henry Ford,” executive coaching was described as a “controversial” hybrid of management consulting and psychotherapy.

William Henry Vanderbilt was the son of the financier and steamship and railroad promoter Cornelius “Commodore” Vanderbilt (1794-1877). He overcame both debilitating ill health during the first half of his life and his fathers skepticism about his promise as a businessman to establish himself in the railroad business by the time he was in his midforties. When his father died, William Vanderbilt inherited the bulk of an estate estimated to be worth about ninety million dollars. In less than a decade he had more than doubled the sum. By the time Vanderbilt engaged Herter, the firm had carried out decorating schemes for a good number of Americas newly rich, many of whom, like Vanderbilt, had made their fortunes developing the railroads that were crisscrossing the nation.(6) It is possible that Vanderbilt had visited and admired their houses, reinforcing his approval of Herter Brothers, which had previously decorated his house at 459 Fifth Avenue at Fortieth Street, where the Vanderbilts had lived since 1867.(7) In 1878 Herter Brothers proposed $16,355 worth of improvements to the drawing room of the Fortieth Street house, including a parquet floor “in rich, original design”; woodwork “of ebonized cherry inlaid gilt”; a ceiling “in distemper and gold”; “walls in distemper”; bronze chandeliers; curtains “of olive velours cisele trimmed with rich embroidered bands”; divans, armchairs, and “lady” chairs in olive velours; and light chairs and tabourets “in fancy covering.”(8)
WITH one notable exception, Oaklands historic house museums are gearing up for the holidays, say event organizers. “Due to the extensive rehabilitation and restoration work in progress, we are not decorating for the holidays this year,” said Elaine Oldham of the Camron Stanford House on Lakeside Drive near Lake Merritt. “However, we are definitely looking forward to a grand reopening after the first of the year.” Although the Camron-Stanford House will not be decked out as usual, the Cohen Bray, Pardee and Dunsmuir houses will be keeping up their holiday traditions.

The development of the self across academic genres has been addressed in several studies and by several different researchers (see Carol Berkenkotter et al, Paul Kameen, Min-Zahn Lu, Lucille McCarthy and Stephen Fishman, Elspeth Probyn). What this particular study adds to the ongoing discussion/debate of the concept of self is the detail and evidence behind the claim that college is a “time when persons are in process, recomposing themselves toward their futures” (354). In other words, it shows how the idea of self can relate to the “slippery” concept of academic writing through careful exploration of its research subjects. Persons in Process is thus a detailed, longitudinal study that follows its subjects-Nam, Lawrence, Rachel, and Francois-as they struggle to use writing “for the ongoing development of their personal identities, including their sense of themselves in relation to others” (1). Through their subjects, Herrington and Curtis summarize, “we see students striving to bridge the gap between private and public interests, between the personal and the academic, a gap sometimes accentuated by genre conventions and teaching practices” (354). The study prides itself on its length (approximately nine years) and its presentation of the subjects as “expert witnesses” of different aspects of college writing. As a result, it devotes a chapter to each, allowing each one “to speak directly to you” (18). Throughout these chapters the researchers close relationships with these subjects is apparent.

Graphic Design in Germany 1890-1945 covers a period of dramatic change and dislocation. The early years saw the countrys rapid industrialisation, and her increasing belligerence and competitiveness with France, Britain and other world powers, which culminated in the First World War. In defeat, Germany experienced starvation, political turmoil and attempted Soviet- style revolutions in several cities. The Weimar Republic of 1919 to 1933, while being a time of radical cultural experiment, also witnessed the rise of the Nazi party. Finally, during the era of the Third Reich, the country was transformed again, experiencing political censorship, anti- semitism, the establishment of concentration camps, and the waging of the Second World War. Through all these difficulties and upheavals, and possibly inspired by them, there was an engagement with the limits of graphic language. Graphic design as a term was new - it was initially coined by the US typographer Walter Dwiggins in 1922. Avant-garde art inspired experimentation in the use of word and image together and saw a desire to find new forms of expression. Crucially, designers were eager to take their discoveries beyond the rarefied context of fine art. One of the most articulate of the new graphic designers was Hungarian- born Laszlo Moholy-Nagy, who worked at the Bauhaus until 1929. He optimistically pronounced that the illiterate of the future would be those who could not use a camera, “The photograph will be one of the most effective weapons against intellectualisation, against mechanisation of the spirit. Forget reading, see! That will be the motto of education. Forget reading, see! That will be the policy of newspapers.” The National Socialist Party was only too aware of the power of word and image. Despite attempting to ridicule all that had been advocated in the Weimar years - it closed the Bauhaus in 1933 - it used some of the most advanced techniques of film and photomontage to promote its extremist policies.

They argue that, if marijuana, cocaine, heroin, and other drugs were legalized, several positive things would probably occur: (1) drug prices would fall; (2) users would obtain their drugs at low, government-regulated prices, and they would no longer be forced to resort to crime in order to support their habits, (3) levels of drug-related crime, and particularly violent crime, would significantly decline, resulting in less crowded courts, jails, and prisons (this would allow law-enforcement personnel to focus their energies on the “real criminals” in society); and the drug production, distribution, and sale would no longer be controlled by organized crime, and thus such criminal syndicates as the Colombian cocaine “cartels,” the Jamaican “posses,” and the various “mafias” around the country and the world would be decapitalized, and the violence associated with drug distribution rivalries would be eliminated. By contrast, the anti-legalization camp argues that violent crime would not necessarily decline in a legalized drug market. In fact, there are three reasons why it might actually increase. First, removing the criminal sanctions against the possession and distribution of illegal drugs would make them more available and attractive and, hence, would create large numbers of new users. Second, an increase in use would lead to a greater number of dysfunctional addicts who could not support themselves, their habits, or their lifestyles through legitimate means. Hence crime would be their only alternative. Third, more users would mean more of the violence associated with the ingestion of drugs. These divergent points of view tend to persist because the relationships between drugs and crime are quite complex and because the possible outcomes of a legalized drug market are based primarily on speculation. However, it is possible, from a careful review of the existing empirical literature on drugs and violence, to make some educated inferences.

Kmarts home business is on the up and up. The introduction of MSE Home has been such a boon to business–generating more than $1.4 billion in sales from its launch in 1997 through the end of fiscal 2000–that it now stands as a prime example of how a lone brand can single-handedly energize a category. Home, however, will continue to be a core focus. One of Conaways first public appearances when he took over as ceo was the unveiling of MSE Kitchen. At the time, he said, “You are going to see more space [devoted to] home as the store evolves in the future.” The reasons for this are clear; home still offers plenty of opportunities for the company. The company will continue rolling out housewares segments in the aftermath of the kitchen debut.
